As last week’s post pointed out, a bus accident can leave people with serious injuries that may require surgery and hospitalization. However, even more devastating injuries can result when a pedestrian is involved in a bus accident.
Around 8 p.m. on Oct. 13, a 54-year-old woman was struck and killed by a Nassau Inter-County Express Bus in Queens. The accident caused fatal injuries, and the woman was pronounced dead at the scene. Reports indicate that the driver of the bus will not face criminal charges. However, the driver could face a civil lawsuit if the family decides to pursue a wrongful death claim. A wrongful death lawsuit may be appropriate in situations in which people are harmed as a result of a driver’s negligent actions. Drivers have a duty to remain cautious and attentive. When they fail to uphold that duty they should be held responsible. The family of the 54-year-old woman must now try to move on with their lives after this terrible tragedy. Although nothing will take away the pain of losing a loved one, a successful wrongful death lawsuit can provide surviving family members with compensation to cover funeral expenses and to make up for lost wages. Family and friends of the victim of this most recent bus accident say she was kindhearted. They say she was even planning to return home to her native country of Bangladesh. Nothing will bring her back to them. However, they may be given some sense of justice by holding the bus driver accountable through a wrongful death lawsuit.
