This is a case of a newborn who sustained bilirubin encephalopathy in 2004 after his delivery at a major New York Hospital.  The physicians treating the infant failed to timely act on signs of jaundice for a prolonged period of time, ignored the child’s failure to respond significantly to phototherapy, and delayed in administering exchange transfusions for over 18 hours, resulting in the child suffering severe neurological impairment, cerebral palsy and deafness. As a result, the child required hearing aids and ultimately, cochlear transplants.  It is believed that the treating physician was home sleeping at the time of the delay and attributed the symptoms to simple jaundice, failed to appreciate the infant’s serious signs and symptoms, failed to timely order and ensure that exchange transfusions were administered, and failed to address this preventable and unfortunate life-changing injury.
