OB/GYNs Pay the Highest Medical Malpractice Premiums

Feb 21, 2020 | Medical Malpractice

It makes sense that OB/GYNs pay considerably higher premiums due to the high-risk nature of their work. Some multi-million-dollar birth injury medical malpractice verdicts even made headlines in 2019:

  • In July 2019, a Maryland jury awarded $229 million in a birth injury medical malpractice lawsuit whereby an infant girl suffered brain injuries during her birth at Johns Hopkins Bayview Medical Center due to medical malpractice
  • In November 2019, a jury in Cook County, Illinois awarded $101 million to a single mother in a birth injury medical malpractice lawsuit whose child was born with serious brain damage at West Suburban Medical Center due to medical malpractice
  • In March 2019, another Cook County Jury in Illinois awarded $23.5 million in a birth injury medical malpractice lawsuit, whereby an infant suffered severe brain damage at Presence St. Joseph Hospital due to medical malpractice

Most of the physicians that participated in the report felt that lawsuits occurred because patients don’t understand medical risks (71%) blame bad outcomes on doctors. Consequently, they seek restitution and want to assign responsibility to someone (63%) to receive compensation.

While some physicians believe medical malpractice lawsuits are uncalled for, others believe that they are necessary to protect patient rights and ensure the best possible standard of care, with one internist saying “there is literally no other way for patients injured in any fashion to be compensated for their additional costs, pain, and suffering.”

Legal Matters

Legally, medical malpractice is something that occurs when a healthcare provider deviates from the accepted standard of care and is negligent when treating you. A medical malpractice claim usually exists if a provider’s negligence causes your injury.

Unfortunately, the prosecution of medical malpractice cases can be extremely expensive, stressful, and time-consuming. You need to be smart about how you proceed, and consulting with a medical malpractice lawyer is the best way to go about it.

There is a statute of limitations in medical malpractice law that is specified in each state. If you live in NYC, then you should consult with an NYC medical malpractice attorney.

Being proactive is the best step you can take to avoid a medical malpractice lawsuit altogether. Make sure you do your research to understand your health condition and ensure that you consult with well-reputed doctors. Don’t be afraid to get a second opinion and never settle with letting a healthcare provider treat you if you are not 100% satisfied with the service they are offering.
