New Jersey Dentist Suspended After Causing Patient’s Wrongful Death

Mar 9, 2020 | Medical Malpractice

According to reports, the oral surgeon’s failure to adhere to correct infection control protocols when extracting teeth between 2012 and 2014 led 15 patients to suffer from endocarditis, 12 of whom required surgery to address the injury, and one of whom sadly died as a result. None of these patients had a cardiac history before their tooth extractions, and at least four patients who had to undergo cardiac surgery were under the age of 26.

Worse, several complaints reveal that the oral surgeon failed to follow these infection control protocols despite numerous inspections by the Department of Health, which informed him of these deficiencies. The Department of Health suspended his license in 2016 after discovering that some of the infection control breaches included:

  • Failure to use sterile water during procedures
  • Failure to sterilize equipment in preparation for their use
  • Failure to properly handle and dispose of needles

The oral surgeon is due to begin his one-year probationary period in August 2020 as part of his five-year suspension, which began in August 2016.

Legal Matters

Wrongful death is a death that occurs due to the negligent or reckless behavior of another person or institution. In medical malpractice law, this includes doctors, nurses, hospital administrators, and other healthcare professionals or healthcare organizations.

Importantly, a wrongful death medical malpractice lawsuit is not the same thing as a criminal case. It is a civil action, which means that it requires the gathering and presenting of evidence for the claim to be settled; so, your best plan of action when seeking to file a wrongful death medical malpractice lawsuit is to contact a medical malpractice lawyer who can guide you through the complicated process.

By liaising with this knowledgeable professional, you’ll be able to discern whether your claim is valid and the occurrence of medical malpractice is clear, or if you could face potential issues in court. They will then be able to assist you with the process that follows.

You should contact an NYC medical malpractice attorney if you live in NYC, as they understand the medical malpractice laws and the statute of limitations specific to the state, and are the most qualified to represent you and assist with your case.
